What to Disclose When Selling Your Home in California

When selling a home in California, one of the most important responsibilities you have as a seller is full and honest disclosure. California has some of the strictest disclosure laws in the country, designed to protect buyers and ensure transparency in real estate transactions. Failing to disclose known issues can not only delay or derail your sale but could also lead to legal trouble down the road.

Here’s what you need to know.

The Seller’s Disclosure Obligation

Under California law, sellers must provide buyers with a Transfer Disclosure Statement (TDS). This document outlines the condition of the property and alerts buyers to any material facts that could affect its value or desirability.

Think of it as answering the question: “If I were the buyer, what would I want to know?”

Key Disclosures Required in California

  1. Structural and Mechanical Issues

    • Roof leaks, foundation cracks, plumbing or electrical problems.

  2. Past Repairs or Renovations

    • Major fixes, additions, or remodels, even if permitted.

  3. Water Damage and Mold

    • Any history of flooding, leaks, or mold, no matter how small.

  4. Pests

    • Termite infestations or damage from rodents and other pests.

  5. Neighborhood and Environmental Factors

    • Noise issues, nearby construction, or known hazards such as flood zones, fire zones, or earthquake risks.

  6. Legal and Title Issues

    • Liens, disputes over property lines, or HOA restrictions.

  7. Deaths on the Property

    • In California, sellers must disclose if a death occurred on the property within the past 3 years (natural, accidental, or otherwise).

  8. Natural Hazard Disclosure (NHD)

    • Whether the property is in a designated hazard zone (flood, fire, earthquake fault line, etc.).

Why Full Disclosure Protects Sellers Too

Some sellers fear disclosing too much, but in reality, transparency works in your favor:

✔️ Builds buyer trust.

✔️ Reduces the risk of deals falling apart.

✔️ Protects you from lawsuits after closing.

Tips for a Smooth Disclosure Process

  • Be thorough and honest — even minor issues should be mentioned.

  • Gather documentation for repairs, warranties, and permits.

  • Work with your agent to ensure all forms are complete and accurate.

  • Remember: If you know it, disclose it.

Bottom Line

Disclosures aren’t just a formality — they’re a legal requirement and a vital part of selling your home in California. By being transparent and proactive, you protect yourself, build confidence with buyers, and help your transaction move forward smoothly.
